Terms of Service

Article 1: Presentation of the TOS

1.1 These Terms of Service (hereinafter referred to as the “TOS” or the “Agreement”) set forth the terms for using the services provided by the sole proprietorship owned by Emmanuel Russeil, registered under number 753 139 872. Hereinafter referred to as “Minimal Roleplay”, the “Company”, or “Us”.

1.2 These services include, among others, access to the Minimal Roleplay website (hereinafter referred to as the “Site”), the Apple and Android applications (hereinafter referred to as the “Applications”), as well as the Minimal Campfire social network (hereinafter referred to as the “Social Network”).

The site, applications, and social network are collectively referred to as the “Platform” or the “Services”.

1.3 When you use our Platform, we may ask you to provide us with personal data. To learn more about how we process this information, we invite you to carefully read our Privacy Policy available at the following link: https://minimalroleplay.com/legals/privacy-policy.

1.4 Thus, the TOS determine the contractual framework of the relationships between the user of the Platform (hereinafter “you”) and Minimal Roleplay.

Article 2: Acceptance of the TOS

2.1 You acknowledge that you are a natural person who has reached the age of majority in your country of habitual residence or, if you are a minor and the law of your country of habitual residence requires it, you have obtained the consent of your legal representative (parent or guardian) to create an Account and/or access the Platform. You also acknowledge that you are capable of entering into a valid contract under the law, case law, or customs of your country of habitual residence.

2.2 Any use of the Platform not in accordance with the TOS is prohibited and may result in termination in accordance with the provisions set forth in Article 10 below.

2.3 Acceptance of the TOS is materialized by your electronic signature, evidenced by checking the box provided for this purpose or clicking the button to accept the TOS or the button to complete the creation of your Account. This acceptance is required to create an Account and/or use the Platform. In case of disagreement with these provisions, you must not check the box or click the button to accept the TOS. In the event of an update of the TOS, you will be asked to indicate your agreement by means of a checkbox or by clicking a button to accept the TOS, failing which you will no longer be able to access the Platform.

Article 3: Access

3.1 The Platform being offered on the Internet, in order to access it, you must have an Internet connection. All costs for telephone connections and Internet access are your responsibility. Minimal Roleplay is not responsible for any damage that you may suffer as a result of using an Internet connection or the installation of malware on your mobile device.

3.2 The Platform may be accessible via a mobile device. The term “mobile device” refers to any portable device capable of connecting to the Internet to access said Platform (mobile phones, tablet computers, etc.). You acknowledge that the quality of the Platform, the response time, or access to certain features may depend on the capabilities of your mobile device and the electronic communication network. You acknowledge that the Platform offered by Minimal Roleplay on mobile devices may not be available on all mobile devices.

3.3 Minimal Roleplay grants you only a limited, non-exclusive, and non-transferable license to access and use the Platform and its content. This license is subject to compliance with the rules set forth in the TOS.

3.4 To access the Platform and/or all of its features, Minimal Roleplay may ask you to create an account (hereinafter referred to as the “Account”). You can create an Account from the sections provided for this purpose on the Site or the Applications, found in the “Create an account” or “Registration” area.

3.5 Certain features are accessible without having to complete the Account creation form.

Please note that the Platform will not be fully accessible. To obtain full access, we will ask you to register an Account by filling out the Account creation form.

As far as they are compatible with the provisions set forth in the TOS, the rules regarding the Account are applicable. For example, the sanctions provided for in Article 6 of the TOS are applicable.

Article 4: Account Creation

4.1 Characteristics

4.1.1 To create an Account, you must be a natural person who has reached the legal age in your country of habitual residence or, if you are a minor and the law of your country of habitual residence requires it, have obtained the consent of your legal representative (parent or guardian), and must, in any case, be legally capable of contracting with the Company.

4.1.2 The Account is a user account made available to you via a username (Account name or email address) and a password.

4.1.3 The Account remains the property of the Company. You only hold a right of access to the Services through an Account provided to you.

4.1.4 To create an Account, you will need to enter the following information:

• Email address
• Password
• Date of birth

Depending on the applicable legislation in your country of habitual residence, the Company may ask you to provide the email address of your legal representative (parent or guardian) so that they can give their consent to the creation of your Account.

An email address and/or an Account name can only serve as an identifier for a single Account.

When you first access the Platform, you will be asked to provide additional information.

Minimal Roleplay reserves the right to limit the number of Accounts that can be created from the same IP address over a given period.

4.1.5 The management of the Account and personal information is done only in the Account management interface %URL_COMPTE% (hereinafter referred to as the “Account Management”).

4.1.6 The identifier (Account name or email address) and password allow you to access the Platform. The email address allows us to communicate with you regarding the management and tracking of your Account and to send you information related to the Platform.

4.1.7 The Account must comply with at least the following rules:

• Personal information must be accurate, verifiable, complete, and up-to-date. A personal and valid email address must be provided.
• Automated Account creation and/or using a false or fraudulent identity is strictly prohibited.

In the event of changes to your information, you must update it from your Account Management or by contacting Support as soon as possible.

4.2 Account Creation Rules

4.2.1 The Account name is visible to other users.

4.2.2 The email address is not visible to other users.

4.2.3 The Account name, party names, and all creations made and published on Minimal Roleplay must comply with at least the following rules:

• correspond to a pronounceable word (for example, the word dufgvosxfp does not comply with this rule)
• not have an offensive, inappropriate, or inappropriate character
• not refer to a political orientation, ethnicity, community, or religion
• not be vulgar or insulting
• not have a sexual or even pornographic connotation
• not contain your name and/or surname
• not resemble or imitate a registered trademark or a term protected by copyright
• not promote a commercial service
• not refer to a narcotic product or any other entity prohibited by legislation
• not resemble or imitate the name of a moderator or a member of the Company
• not be spelled or spelled alternately in order to circumvent the above-imposed rules
• not combine your first name and surname, which, when combined, would contravene the rules set forth above

The assessment of compliance or non-compliance with these rules is left to the sole discretion of the Company.

4.3 Responsibility / Security

4.3.1 Security

To ensure the security of your Account and to prevent the commonly known “Account hack,” you commit to:

• not grant access to your Account to a third party. Lending, sharing, exchanging, gifting, buying, transferring, and selling Accounts (or attempts thereof) are prohibited. Any lending, sharing, exchanging, gifting, buying, transferring, or selling of an Account will not be enforceable against the Company and may result in the sanctions provided for in Article 6 of the TOS.
• take all measures to prevent a third party from accessing the Account you have activated, even without your knowledge
• not use a third party's Account
• not disclose your identifiers, namely the password and email address
• allow Minimal Roleplay to easily contact you, for any reason, via your email address

4.3.2 Responsibility

4.3.2.1 The security of your Account is solely your responsibility, and Minimal Roleplay cannot be held liable for any damages that your Account, computer, or mobile device may suffer as a result of the loss or sharing of your Account identifiers.

4.3.2.2 Minimal Roleplay cannot, in any way, be held responsible in case of Account theft or any alteration that your Account may suffer.

4.3.2.3 You also acknowledge that you are presumed to be the user of your Account and the responsible party for actions taken through your Account and on your Account.

4.3.2.4 You acknowledge that you, and not Minimal Roleplay, are responsible for all electronic communications and content sent from your computer or mobile device and that you should only use the Platform in compliance with laws and the TOS.

4.4 Certification

When creating your Account, Minimal Roleplay asks you to certify it. Certification of the Account is mandatory. To certify your Account, you must provide the information specified in Article 4.1.

If your Account has already been certified, Minimal Roleplay reserves the right to request by any means that you justify your date of birth.

It is reminded that all the information you provide in the context of the TOS must be accurate.

Article 5: Platform

5.1 Code of Conduct / Prohibited Activities

By using the Platform, including the communication services provided, you agree to follow these rules:

5.1.1 You agree not to insult, threaten other users or Company staff, or make racist, shocking, offensive, discriminatory statements, or those contrary to French, European, or international law, regardless of the language used. Minimal Roleplay shall not be liable for any violation of this paragraph.

5.1.2 You also agree not to send "spam," commercial offers of any kind to other users; steal Accounts or attempt to do so; threaten, harass, or embarrass other users by any means; provide other users with personal information about yourself or another user; collect information on the Platform.

5.1.3 You are prohibited from any form of advertising or commercial promotion. Minimal Roleplay may, however, allow, at its sole discretion, the dissemination of advertisements or commercial promotions provided that they do not contain any content violating current legislation and the CGU.

5.1.4 On the Platform, each part (solo and multiplayer parties, creation tools) has its purpose. You agree to use them in accordance with their functionality. Non-compliant use may lead to sanctions, particularly when made abusively and deliberately.

5.1.5 Your public written communications may be recorded, analyzed, or removed by Minimal Roleplay, so that it can check whether your communications comply with the laws and the CGU. You acknowledge that you, and not Minimal Roleplay, are responsible for all intra-platform communications and content sent from your computer or mobile device and that you must only use the Platform in compliance with the laws and the CGU.

5.1.6 You agree not to exploit flaws, bugs, or any other form of errors to modify the behavior of the Platform and/or to obtain advantages and collectibles on the Platform, nor to promote such use. Similarly, you agree to immediately notify Minimal Roleplay when you notice a flaw or error on the Platform via its Support.

5.1.7 You are prohibited from participating in, organizing, or being involved in an attack against the servers of Minimal Roleplay.

5.1.8 More generally, use of the Platform must not violate national and international laws and regulations.

5.2 Game Elements

All elements that you can obtain on our Platform, whether purchased by you, obtained by you as a result of your use of Minimal Roleplay, or in exchange for usage rights of virtual currencies such as dice fragments (hereinafter "Credits"), including without limitation, founder doors, dice, roleplayer cards, titles, badges, table backgrounds, roleplayer card backgrounds, and all collectible elements of the Platform (hereinafter collectively referred to as the "Game Elements") are associated with your Account. You acknowledge that the Game Elements are and remain the exclusive property of the Company. The provision of Game Elements by the Company is strictly personal and limited to the experience on the Platform. The Company exclusively grants you a right of use on the Game Elements; this does not constitute a transfer of ownership, which you expressly acknowledge. Thus, this right of use will expire at the latest at the time of the closure of your Account, whatever the cause.

You acknowledge that the Game Elements have no financial value in the real world. It is strictly prohibited to exchange them for real money. Generally, lending, sharing, exchanging, gifting, buying, transferring, and selling Game Elements (or attempting to do so), outside the Platform and its rules, are strictly prohibited and may result in sanctions on your Account.

Due to the ongoing development of the Platform and in particular to ensure the most balanced experience possible among users, Minimal Roleplay reserves the right to modify or remove Game Elements.

5.3 Update / Modifications

To improve the experience of the Platform, Minimal Roleplay reserves the right to make updates and modifications to the Platform. The Platform and its updates constitute an indivisible whole, inseparable from their components, all of which remain subject to the CGU.

5.4 User Content

5.4.1 Definition

Minimal Roleplay allows you to publish content, images, sounds, scenarios, character sheets, solo adventures, links, messages, private messages, and other documents (hereinafter referred to as "User Content"). You retain all rights to the User Content you publish on the Platform and assume full responsibility for it. All User Content must comply with these Terms and our policies.

You must only publish User Content that you have the right to publish and must refrain from publishing User Content that infringes on the intellectual property rights of others (for example, copyright infringement, trademark infringement, or counterfeiting), or that is illegal in any other way, unless an exception or limitation applies under applicable laws.

Minimal Roleplay reserves the right to modify or delete User Content that violates these Terms, or when we are authorized or required by law to do so. We may also sanction Accounts that repeatedly or severely infringe upon the intellectual property rights of third parties, violate the law, these Terms, or when we are authorized or required by law to do so.

We are a neutral intermediary and do not review all User Content before or after its publication on the Platform, and we are therefore not liable to third parties for the content or accuracy of any User Content published by you or by any other user.

5.4.2 Rule of Public User Content

5.4.2.1 Definition: Public User Content refers to any content created by a user and accessible to multiple users on Minimal Roleplay. Some User Content is immediately considered public, such as private messages, applications, or messages exchanged in game tables. Additionally, user content may become public at the user’s initiative and with moderation approval, for example during its publication in public galleries (for character sheets, scenarios, or adventures), its addition to the directory of parties, or the activation of spectator mode for multiplayer parties.

5.4.2.2 Public User Content must at least comply with the following rules:

• correspond to a pronounceable word (for example, the word dufgvosxfp does not comply with this rule)
• not have an offensive, inappropriate, or misplaced character
• not refer to a political orientation, ethnicity, community, or religion
• not be vulgar or insulting
• not have sexual or pornographic connotations
• not contain your first and/or last name
• not resemble or imitate a registered trademark or a term protected by copyright
• not promote a commercial service
• not refer to a stupefying product or any other entity forbidden by legislation
• not resemble or imitate the name of a moderator or a member of the Company
• not be spelled or spelled alternately to circumvent the rules imposed above
• not combine your first and last name, which, when assembled, would violate the rules set forth above

In the context of private conversations and private game tables, some of these rules may not apply. The assessment of compliance or non-compliance with these rules is left to the sole discretion of the Company.

5.4.3 Validation and Moderation of Public Content

5.4.3.1 Public User Content

In addition to the rules mentioned above, user content will only be approved and made public if it is deemed complete and relevant to the platform. It must include clear, accurate, and non-misleading descriptions and elements intended for users and readers.

5.4.3.2 Public ERP (Erotic Roleplay)

ERP (Erotic Roleplay) parties must be explicitly identified as such by checking the "Erotic Roleplay" box when published. Furthermore, for validation to be possible, it is strictly prohibited to include explicit elements directly revealing the erotic nature of the roleplay in descriptions or titles. It is strictly forbidden to publish ERP parties involving minors or referencing works that explicitly depict minors.

5.4.4 Rights and Intellectual Property

All User Content published on Minimal Roleplay remains the exclusive property of its author. As the creator, the user retains all intellectual property rights over their content.

Any use, reproduction, modification, or exploitation of this content outside the platform, without the explicit authorization of the author, constitutes a violation of their rights. The author is entitled to take any necessary measures, including legal action, to protect their content and seek remedies in the event of unauthorized use.

Minimal Roleplay reserves the right to collaborate with the author to enforce these rights if such a situation were to arise. By publishing content on the platform, the user also acknowledges that they are solely responsible for the originality and legality of this content.

5.4.5 Marketing Use

Minimal Roleplay reserves the right to use User Content in communications to promote the Platform, in official documents, and on social media.

You will always be notified and credited when your User Content is used by us.

Article 6: Sanctions

6.1 In the event of a violation of one or more provisions of the CGU or any other document incorporated herein by reference, Minimal Roleplay reserves the right to terminate or restrict, without any prior warning and at its sole discretion, your use and access to the Platform, to your Account, and to sanction you within the framework of the Platform. Sanctions are specific to certain Services, including the Site and Applications as well as the Social Network.

6.2 Sanctions depend on the severity of the violation. These sanctions are as follows (non-exhaustive list):

• Warning: The warning has no direct consequence on the Account. You may continue to use the Platform unchanged. The warning is primarily there to caution you that you risk more severe sanctions if you continue to violate the CGU rules.
• Speech deprivation: You may be restricted from creating public content, such as writing articles on the Social Network, using private chat, creating and participating in public parties, publishing any kind of User Content.
• Temporary suspension: You will no longer be able to access your Account for several days. The duration depends on several criteria, particularly the severity of the breach committed and any recidivism.
• Permanent suspension: The Account is permanently banned, and you will no longer have access to it. This sanction is generally applied in cases of recidivism or serious or unforgivable violations of the CGU.

6.3 Minimal Roleplay reserves the right to apply any sanction mentioned in the previous paragraph to an Account, considering the severity of the violation, without necessarily warning you or applying a lesser duration sanction beforehand.

6.4 Minimal Roleplay also reserves the right to modify Account names and User Content that do not comply with the rules set out above and those deemed inappropriate by Minimal Roleplay. Minimal Roleplay may, if necessary, temporarily or permanently suspend access to the Account or delete User Content, without compensation.

6.5 Minimal Roleplay reserves the right to permanently suspend your Account based on the severity of the violation.

6.6 In addition to the sanctions described above, Minimal Roleplay may impose necessary sanctions, including initiating civil and criminal proceedings against the offender.

6.7 If Minimal Roleplay notices any suspicious or unusual behavior or transactions on your Account that may lead to a violation of the CGU, Minimal Roleplay reserves the right, at its sole discretion, to block your Account while performing checks or an investigation.

6.8 If you have acquired, directly or indirectly, Game Elements fraudulently, Minimal Roleplay reserves the right to access your Account and delete all or part of the elements in your possession.

6.9 Defaming, insulting, harassing, threatening a staff member, a representative, a moderator, or any other person linked or affiliated with Minimal Roleplay or any of its partners and providers, displaying harmful, violent, obscene, vulgar, hateful, shocking behavior towards those persons, invading their privacy or infringing their rights in any other way may lead to sanctions on your Account, regardless of the means of expression used.

Article 7: Support

7.1 You can contact Support by the following means:

• By chat by “invoking an admin” in your private chat interface
• By email at bipboup@minimalroleplay.com

7.2 Support will do everything possible to assist you in a timely manner. However, Support reserves the right not to respond to a request, particularly in cases of non-compliance with the rules of this article.

7.3 Any harassment, threats, insults, or other inappropriate behavior towards Support members will result in the cessation of processing your request and may lead to sanctions in accordance with article 6.9.

7.4 In the event of identity theft and/or falsification of documents and/or attempts of either of these offenses, Support reserves the right to sanction the Account belonging to the fraudster.

7.5 If you reasonably suspect a security flaw, including the loss, theft, or unauthorized use of your credentials or any other security-related issue with your Account, you must immediately notify Minimal Roleplay via its Support. Subject to verifying your identity, Support may then reset your password and offer solutions to enhance the security of your Account. Support may also block access to the relevant Account while conducting an investigation. Following the investigation, Support will determine the outcome at its sole discretion.

Article 8: Liability and Warranty

8.1 Minimal Roleplay will do everything possible to ensure the proper functioning of the Services and provide you with Services 24/7.

8.2 Nevertheless, Minimal Roleplay only has an obligation of means regarding access to and use of the Services. Minimal Roleplay cannot guarantee that the functions offered by the Services will always be available or free from typographical, technical, or other errors, that defects will be corrected, or that the Services or servers hosting them are free from viruses or bugs. Minimal Roleplay does not guarantee the availability of the Services at any time, anywhere, or at any specific moment, nor the maintenance of a Service offering for any specific defined period.

8.3 For maintenance, testing, security, repair, or any other reason related to improving and/or ensuring the proper functioning of the Services, they may be temporarily interrupted by Minimal Roleplay, without its liability being engaged. Minimal Roleplay will decide solely whether or not to grant you compensation in kind in the event of an interruption of the Services.

8.4 The Company's liability cannot be engaged in cases of force majeure provided for by law.

8.5 Minimal Roleplay provides the Services as long as they are edited. Minimal Roleplay therefore reserves the right to cease editing the Services, and consequently to indefinitely interrupt the Services, with you being informed by any means. Minimal Roleplay may also permanently interrupt the Services in the event of cessation of activity.

8.6 Unless otherwise provided by law or specific conditions expressly agreed upon between Minimal Roleplay and you, you acknowledge and agree that:

• the Services and their content are provided "as is"
• the use of them is entirely at your own risk. For underage users, responsibility lies with their legal representatives
• Minimal Roleplay is exempt from any liability in case of use of the services not in accordance with the CGU. It shall not be held liable for direct or indirect damages, data or profit losses, that may occur due to the use or non-use of the services, negligence, or any other reason associated with the services
• any communication between Minimal Roleplay and you, whether oral or written, cannot give rise to any warranties not provided for by the CGU
• Minimal Roleplay shall not be held responsible for your errors or omissions
• Minimal Roleplay cannot in any case be compelled to refund you any amount in the event of a default.

8.7 Similarly, regarding links from Internet pages or others leading to the Services but not managed by Minimal Roleplay or links contained in the Services leading to Internet pages or others managed and edited by third parties, Minimal Roleplay cannot be held liable for their content in the event that the third parties managing and editing such content do not comply with French, European, or international regulations.

8.8 Some countries do not allow exclusions or limitations of liability. Thus, the limitations or exclusions mentioned may not apply to you.

8.9 Subject to the preceding provisions, if the liability of the company should be engaged in connection with your use of the Services, the amount of compensation that you may claim is limited to the amount of sums you have paid for access to the Services during the twelve months preceding your claim.

Article 9: Intellectual Property / Trademarks

9.1 All elements, features, tools, documents that are part of the Minimal Roleplay universe and provided by Minimal Roleplay (including but not limited to, the Platform and all content offered, Accounts, Credits, Game Elements, source code, theme, artwork, mode of operation, moral rights, documentation, design, and ergonomics) are protected by French and international copyright and intellectual property laws. All these elements, features, tools, and documents belong to Minimal Roleplay. Unless prior written authorization from Minimal Roleplay, you agree not to trade elements arising from the creations of Minimal Roleplay and not to promote such activities infringing on Minimal Roleplay's rights. Minimal Roleplay will do everything possible to prevent such acts.

9.2 All data related to the Services belong to Minimal Roleplay and are protected by French, European, and international copyright laws. You do not have the right, in whole or in part, to copy, reproduce, translate, extract, modify source code, disassemble, decompile, modify, rent, sell, distribute or create derivative works inspired by the Services or content without the prior written consent of Minimal Roleplay.

9.3 All trademarks appearing on the Platform are trademarks created by the Company or for which it holds exploitation rights. You may not use these trademarks without the prior written consent of Minimal Roleplay. You are not permitted to use meta-tags or other "hidden text" utilizing the names and trademarks of Minimal Roleplay without its prior written consent. Other trademarks appearing on the Platform, which do not belong to Minimal Roleplay, belong to their respective holders.

9.4 Any non-compliance with this puts an end to the authorization or license granted by Minimal Roleplay.

Article 10: Termination

10.1 This Agreement comes into effect on the day of your acceptance and remains in effect until its conclusion, unless one of the parties, namely you or Minimal Roleplay, terminates it early.

10.2 Termination at your initiative: You can request the closure of your Account at any time and without any reason, subject to verifying your identity. You must then inform Minimal Roleplay via its Support. Subject to complying with the termination procedure mentioned above, the termination of your Account will take effect within a reasonable time after the receipt of your request by Support.

10.3 Termination at the initiative of Minimal Roleplay:

Termination for breach: Minimal Roleplay may close your Account with or without prior notice, if you do not comply with the laws, the rules set forth by the CGU, the General Terms of Sale, and all documents expressly incorporated herein by reference. Minimal Roleplay also reserves the right to take all measures necessary to repair the harm it has suffered.

Termination for inactivity: Minimal Roleplay also reserves the right to proceed by operation of law and at any time to close inactive Accounts. An account is considered inactive when it has not been logged into the Platform for a period of twelve (12) consecutive months. An Account on which at least one purchase has been made will never be considered inactive. At least fifteen (15) days before proceeding with the closure of the Account, we will notify you by sending a message to the email address associated with your Account.

10.4 Consequences of the termination regardless of who it is by: In all cases, the closure of the Account will result in termination of the Agreement by operation of law and, therefore, you will no longer be able to access the Services.

Article 11: General Provisions

11.1 Severability: If any condition or term of this Agreement is deemed illegal, invalid, or unenforceable, that condition or term will be removed without prejudice to the application of the other provisions.

11.2 Absence of waiver: No waiver by Minimal Roleplay of a right or provision of the CGU shall be construed or interpreted as a waiver of that right or provision. No representative of Minimal Roleplay nor any other personnel in contact with you is legally authorized to bind Minimal Roleplay to any modification or waiver of the provisions of the CGU.

11.3 Entirety: The CGU, as well as all documents expressly incorporated herein by reference, constitute the entirety of the agreement concluded between you and the Company regarding the Services and prevail over all prior or contemporary communications, electronic, verbal, or written, between you and the Company regarding the Services; it being understood, however, that the Agreement shall coexist with, and not replace, the Privacy Policy and the General Terms of Sale.

11.4 Review: Minimal Roleplay reserves the right to modify, add, and/or delete certain rules provided for by the CGU. You will be notified by any means of substantial modifications made to the Agreement at the moment you attempt to access one of our Services. You acknowledge that by using the Services after being informed of the modifications, additions, and/or deletions, you accept these modifications, additions, and/or deletions.

11.5 Governing law: The CGU is subject to French law and in the French language.

11.6 Survival of terms: In the event of termination of the CGU, articles 3.1, 5.1, 5.2, 5.4, 8, 9 and 11 will continue to apply.
